Products and Services Export Policy

1. Export Administration Regulations. Algotive's technologies, products and services are subject to U.S. export standards known as Export Administration Regulations ("EAR") and enforced by the U.S. Department of Commerce's Bureau of Industry and Security ("BIS").

2. Other applicable controls. Both the Treasury Department and the State Department regulate and control other types of transfers and transactions of export-related technology and products. The U.S. Department of the Treasury's Office of Foreign Assets Control ("OFAC") administers and enforces economic sanctions against certain countries and regimes, terrorists, and other threats to U.S. national security, foreign policy, or economic interests.

3. Our Policy. It is Algotive's policy to comply with the EAR, OFAC and Wassenaar International Agreement rules and proceed with the proper classification of its products and services (resulting in the determination of an ECCN – Export Control Classification Number) so that Algotive products can be easily and quickly exported to non-embargoed destinations while maintaining a high level of compliance.

4. Compliance. In general, Algotive software products are not subject to EAR, therefore they are not on the Trade Control List and do not have ECCN, or are EAR99, or are 5D992 Mass Market eligible for Algotive self-classification and may be exported to countries not subject to however without a license such as "No License Required" (NLR).

a. Some of Algotive's Products and Services have an assigned ECCN that may or may not require a license, and the EAR or legal counsel should be consulted to determine the appropriate license type and eligible countries for export purposes.

5. Responsibilities. Without limitation, parties acquiring Algotive software are responsible for obtaining all licenses or other approvals necessary to acquire, download or transfer Algotive Products and Services. A party may not transfer the software or services without the permission of the United States government to (a) any person on the U.S. Department of the Treasury's lists of specially designated citizens (including the government of Iran, the government of Cuba, prohibited members of the Communist Party of Cuba) or on the Denied Persons List, the U.S. Department of Commerce's Entity List or Non-Verified List, or the U.S. Department of State's Exclusion List or Nonproliferation List (see Trade Lists to Verify); or (b) for use with chemical or biological weapons, sensitive nuclear end-uses, or missiles to launch them.
